12 <\/p>\n\n<p><strong>Seite 2<\/strong><br\/>\u00a7 1 Geltungsbereich<br\/>1.1 Diese Allgemeinen Gesch\u00e4ftsbedingungen f\u00fcr die Hotellerie (im Folgenden<br\/>\u201eAGBH 2006\u201c) ersetzen die bisherigen \u00d6HVB in der Fassung vom 23. September 1981.<br\/>1.2 Die AGBH 2006 schlie\u00dfen Sondervereinbarungen nicht aus. Die AGBH 2006<br\/>sind gegen\u00fcber im Einzelnen getroffenen Vereinbarungen subsidi\u00e4r.<br\/>\u00a7 2 Begriffsdefinitionen<br\/>2.1 Begriffsdefinitionen:<br\/>\u201eBeherberger\u201c: Ist eine nat\u00fcrliche oder juristische<br\/>Person, die G\u00e4ste gegen Entgelt beherbergt.<br\/>\u201eGast\u201c: Ist eine nat\u00fcrliche Person, die Beherbergung in Anspruch nimmt. Der Gast<br\/>ist in der Regel zugleich Vertragspartner. Als Gast gelten auch jene Personen, die mit dem Vertragspartner anreisen (zB Familienmitglieder, Freunde etc).<br\/>\u201eVertragspartner\u201c: Ist eine nat\u00fcrliche oder juristische Person des In- oder Auslandes, die als<br\/>Gast oder f\u00fcr einen Gast einen Beherbergungsvertrag abschlie\u00dft.<br\/>\u201eKonsument\u201c und<br\/>\u201eUnternehmer\u201c: Die Begriffe sind im Sinne des Konsumentenschutzgesetzes 1979 idgF zu<br\/>verstehen.<br\/>\u201eBeherbergungsvertrag\u201c: Ist der zwischen dem Beherberger und<br\/>dem Vertragspartner abgeschlossene<br\/>Vertrag, dessen Inhalt in der Folge n\u00e4her geregelt wird.   <\/p>\n\n<p><strong>Seite 3<\/strong><br\/>\u00a7 3 Vertragsabschluss \u2013 Anzahlung<br\/>3.1 Der Beherbergungsvertrag kommt durch die Annahme der Bestellung des Vertragspartners durch den Beherberger zustande. Elektronische Erkl\u00e4rungen gelten<br\/>als zugegangen, wenn die Partei, f\u00fcr die sie bestimmt sind, diese unter gew\u00f6hnlichen Umst\u00e4nden abrufen kann, und der Zugang zu den bekannt gegebenen Gesch\u00e4ftszeiten des Beherbergers erfolgt.<br\/>3.2 Der Beherberger ist berechtigt, den Beherbergungsvertrag unter der Bedingung<br\/>abzuschlie\u00dfen, dass der Vertragspartner eine Anzahlung leistet. In diesem Fall ist<br\/>der Beherberger verpflichtet, vor der Annahme der schriftlichen oder m\u00fcndlichen<br\/>Bestellung des Vertragspartners, den Vertragspartner auf die geforderte Anzahlung hinzuweisen. Erkl\u00e4rt sich der Vertragspartner mit der Anzahlung (schriftlich<br\/>oder m\u00fcndlich) einverstanden, kommt der Beherbergungsvertrag mit Zugang der<br\/>Einverst\u00e4ndniserkl\u00e4rung \u00fcber die Bezahlung der Anzahlung des Vertragspartners<br\/>beim Beherberger zustande.<br\/>3.3 Der Vertragspartner ist verpflichtet, die Anzahlung sp\u00e4testens 7 Tage (einlangend) vor der Beherbergung zu bezahlen. Die Kosten f\u00fcr die Geldtransaktion (zB<br\/>\u00dcberweisungsspesen) tr\u00e4gt der Vertragspartner. F\u00fcr Kredit- und Debitkarten gelten die jeweiligen Bedingungen der Kartenunternehmen.<br\/>3.4 Die Anzahlung ist eine Teilzahlung auf das vereinbarte Entgelt.<br\/>\u00a7 4 Beginn und Ende der Beherbergung<br\/>4.1 Der Vertragspartner hat das Recht, so der Beherberger keine andere Bezugszeit<br\/>anbietet, die gemieteten R\u00e4ume ab 16.00 Uhr des vereinbarten Tages (\u201eAnkunftstag\u201c) zu beziehen.<br\/>4.2 Wird ein Zimmer erstmalig vor 6.00 Uhr Fr\u00fch in Anspruch genommen, so z\u00e4hlt<br\/>die vorhergegangene Nacht als erste \u00dcbernachtung.<br\/>4.3 Die gemieteten R\u00e4ume sind durch den Vertragspartner am Tag der Abreise bis<br\/>12.00 Uhr freizumachen. Der Beherberger ist berechtigt, einen weiteren Tag in<br\/>Rechnung zu stellen, wenn die gemieteten R\u00e4ume nicht fristgerecht freigemacht<br\/>sind.      <\/p>\n\n<p><strong>Strana 4<\/strong><br\/>\u00a7 5 Odstoupen\u00ed od smlouvy o ubytov\u00e1n\u00ed \u2013 Stornopoplatek<br\/>Odstoupen\u00ed ubytovatelem<br\/>5.1 Pokud smlouva o ubytov\u00e1n\u00ed stanov\u00ed z\u00e1lohu a z\u00e1loha nebyla smluvn\u00edm partnerem zaplacena v\u010das, m\u016f\u017ee ubytovatel bez<br\/>dodate\u010dn\u00e9 lh\u016fty od smlouvy o ubytov\u00e1n\u00ed odstoupit.<br\/>5.2 Pokud se host nedostav\u00ed do 18:00 hodin sjednan\u00e9ho dne p\u0159\u00edjezdu, neexistuje povinnost ubytov\u00e1n\u00ed, leda\u017ee by byl sjedn\u00e1n pozd\u011bj\u0161\u00ed \u010das p\u0159\u00edjezdu.<br\/>5.3 Pokud smluvn\u00ed partner zaplatil z\u00e1lohu (viz 3.3), z\u016fst\u00e1vaj\u00ed prostory rezervov\u00e1ny nejpozd\u011bji do 12:00 hodin dne n\u00e1sleduj\u00edc\u00edho po sjednan\u00e9m dni p\u0159\u00edjezdu.<br\/>P\u0159i platb\u011b p\u0159edem na v\u00edce ne\u017e \u010dty\u0159i dny kon\u010d\u00ed povinnost ubytov\u00e1n\u00ed od 18:00 hodin \u010dtvrt\u00e9ho dne, p\u0159i\u010dem\u017e den p\u0159\u00edjezdu se po\u010d\u00edt\u00e1 jako<br\/>prvn\u00ed den, leda\u017ee host ozn\u00e1m\u00ed pozd\u011bj\u0161\u00ed den p\u0159\u00edjezdu.<br\/>5.4 Nejpozd\u011bji 3 m\u011bs\u00edce p\u0159ed sjednan\u00fdm dnem p\u0159\u00edjezdu smluvn\u00edho partnera<br\/>m\u016f\u017ee b\u00fdt smlouva o ubytov\u00e1n\u00ed ubytovatelem z v\u011bcn\u011b od\u016fvodn\u011bn\u00fdch d\u016fvod\u016f, leda\u017ee by bylo dohodnuto jinak, jednostrann\u00fdm<br\/>prohl\u00e1\u0161en\u00edm zru\u0161ena.<br\/>Odstoupen\u00ed smluvn\u00edm partnerem \u2013 Stornopoplatek<br\/>5.5 Nejpozd\u011bji 3 m\u011bs\u00edce p\u0159ed sjednan\u00fdm dnem p\u0159\u00edjezdu hosta m\u016f\u017ee b\u00fdt<br\/>smlouva o ubytov\u00e1n\u00ed bez zaplacen\u00ed stornopoplatku jednostrann\u00fdm prohl\u00e1\u0161en\u00edm smluvn\u00edm partnerem zru\u0161ena.<br\/>5.6 Mimo obdob\u00ed stanoven\u00e9 v \u00a7 5.5. je odstoupen\u00ed jednostrann\u00fdm prohl\u00e1\u0161en\u00edm smluvn\u00edho partnera mo\u017en\u00e9 pouze za zaplacen\u00ed n\u00e1sleduj\u00edc\u00edch stornopoplatk\u016f:<br\/>\u2013 do 1 m\u011bs\u00edce p\u0159ed dnem p\u0159\u00edjezdu 40 % z celkov\u00e9 ceny pobytu;<br\/>\u2013 do 1 t\u00fddne p\u0159ed dnem p\u0159\u00edjezdu 70 % z celkov\u00e9 ceny pobytu;<br\/>\u2013 v posledn\u00edm t\u00fddnu p\u0159ed dnem p\u0159\u00edjezdu 90 % z celkov\u00e9 ceny pobytu.  <\/p>\n\n<p><strong>Strana 5<\/strong><br\/>do 3 m\u011bs\u00edc\u016f 3 m\u011bs\u00edce do nep\u0159edv\u00eddateln\u00fdch mimo\u0159\u00e1dn\u00fdch okolnost\u00ed (nap\u0159. extr\u00e9mn\u00ed sn\u011b\u017een\u00ed, povode\u0148 atd.) jsou ve\u0161ker\u00e9 mo\u017enosti p\u0159\u00edjezdu nemo\u017en\u00e9,<br\/>nen\u00ed smluvn\u00ed partner povinen zaplatit sjednanou odm\u011bnu za dny p\u0159\u00edjezdu.<br\/>5.8 Povinnost platby odm\u011bny za rezervovan\u00fd pobyt se obnovuje od mo\u017enosti p\u0159\u00edjezdu, pokud je p\u0159\u00edjezd op\u011bt mo\u017en\u00fd do t\u0159\u00ed dn\u016f.<br\/>\u00a7 6 Zaji\u0161t\u011bn\u00ed n\u00e1hradn\u00edho ubytov\u00e1n\u00ed<br\/>6.1 Ubytovatel m\u016f\u017ee smluvn\u00edmu partnerovi, resp. host\u016fm poskytnout adekv\u00e1tn\u00ed n\u00e1hradn\u00ed ubytov\u00e1n\u00ed (stejn\u00e9 kvality), pokud je to pro smluvn\u00edho partnera \u00fanosn\u00e9, zejm\u00e9na pokud je odchylka nepatrn\u00e1 a v\u011bcn\u011b od\u016fvodn\u011bn\u00e1.<br\/>6.2 V\u011bcn\u00e9 od\u016fvodn\u011bn\u00ed je nap\u0159\u00edklad d\u00e1no tehdy, pokud se pokoj (pokoje) stal (staly) nepou\u017eiteln\u00fdm (nepou\u017eiteln\u00fdmi), ji\u017e ubytovan\u00ed host\u00e9 prodlou\u017e\u00ed sv\u016fj pobyt, existuje overbooking nebo jin\u00e9 d\u016fle\u017eit\u00e9 provozn\u00ed opat\u0159en\u00ed tento krok vy\u017eaduj\u00ed.<br\/>6.3 P\u0159\u00edpadn\u00e9 v\u00edcen\u00e1klady na n\u00e1hradn\u00ed ubytov\u00e1n\u00ed jdou na vrub ubytovatele.<br\/>\u00a7 7 Pr\u00e1va smluvn\u00edho partnera<br\/>7.1 Uzav\u0159en\u00edm smlouvy o ubytov\u00e1n\u00ed z\u00edsk\u00e1v\u00e1 smluvn\u00ed partner<br\/>pr\u00e1vo na obvykl\u00e9 u\u017e\u00edv\u00e1n\u00ed pronajat\u00fdch prostor, za\u0159\u00edzen\u00ed<br\/>ubytovac\u00edho za\u0159\u00edzen\u00ed, kter\u00e9 jsou obvykle a bez zvl\u00e1\u0161tn\u00edch podm\u00ednek host\u016fm p\u0159\u00edstupn\u00e9 k u\u017e\u00edv\u00e1n\u00ed, a na obvyklou obsluhu.<br\/>Smluvn\u00ed partner m\u00e1 sv\u00e1 pr\u00e1va vykon\u00e1vat v souladu s p\u0159\u00edpadn\u00fdmi hotelov\u00fdmi a\/nebo hostovsk\u00fdmi sm\u011brnicemi (domovn\u00ed \u0159\u00e1d).<\/p>\n\n<p><strong>Strana 6<\/strong><br\/>\u00a7 8 Povinnosti smluvn\u00edho partnera<br\/>8.1 Smluvn\u00ed partner je povinen nejpozd\u011bji v okam\u017eiku odjezdu zaplatit sjednanou odm\u011bnu plus p\u0159\u00edpadn\u00e9 dal\u0161\u00ed \u010d\u00e1stky, kter\u00e9 vznikly na z\u00e1klad\u011b zvl\u00e1\u0161tn\u00edho vyu\u017eit\u00ed slu\u017eeb j\u00edm a\/nebo hosty, kte\u0159\u00ed ho doprov\u00e1zej\u00ed, plus z\u00e1konn\u00e1 da\u0148 z obratu.<br\/>8.2 Ubytovatel nen\u00ed povinen akceptovat ciz\u00ed m\u011bny. Pokud ubytovatel akceptuje ciz\u00ed m\u011bny, budou tyto pokud mo\u017eno p\u0159ijaty v platb\u011b podle denn\u00edho kurzu. Pokud by ubytovatel akceptoval ciz\u00ed m\u011bny nebo<br\/>bezhotovostn\u00ed platebn\u00ed prost\u0159edky, nese smluvn\u00ed partner ve\u0161ker\u00e9 s t\u00edm<br\/>souvisej\u00edc\u00ed n\u00e1klady, nap\u0159\u00edklad dotazy u spole\u010dnost\u00ed vyd\u00e1vaj\u00edc\u00edch kreditn\u00ed karty, telegramy atd.  <br\/>8.3 Smluvn\u00ed partner odpov\u00edd\u00e1 ubytovateli za ka\u017edou \u0161kodu, kterou on<br\/>nebo host nebo jin\u00e9 osoby, kter\u00e9 s v\u011bdom\u00edm nebo v\u016fl\u00ed smluvn\u00edho partnera vyu\u017e\u00edvaj\u00ed slu\u017eby ubytovatele, zp\u016fsob\u00ed.<br\/>\u00a7 9 Pr\u00e1va ubytovatele<br\/>9.1 Pokud smluvn\u00ed partner odm\u00edtne zaplatit sjednanou odm\u011bnu nebo je<br\/>s n\u00ed v prodlen\u00ed, m\u00e1 ubytovatel z\u00e1konn\u00e9 zadr\u017eovac\u00ed pr\u00e1vo podle \u00a7 970c ABGB a tak\u00e9 z\u00e1konn\u00e9 z\u00e1stavn\u00ed pr\u00e1vo podle \u00a7 1101<br\/>ABGB na v\u011bcech vnesen\u00fdch smluvn\u00edm partnerem, resp. hostem.<br\/>Toto zadr\u017eovac\u00ed nebo z\u00e1stavn\u00ed pr\u00e1vo m\u00e1 ubytovatel d\u00e1le k zaji\u0161t\u011bn\u00ed sv\u00e9 pohled\u00e1vky ze smlouvy o ubytov\u00e1n\u00ed, zejm\u00e9na za stravov\u00e1n\u00ed, jin\u00e9 v\u00fddaje, kter\u00e9 byly vynalo\u017eeny pro smluvn\u00edho partnera, a<br\/>za p\u0159\u00edpadn\u00e9 n\u00e1roky na n\u00e1hradu \u0161kody jak\u00e9hokoli druhu.<br\/>9.2 Pokud je slu\u017eba po\u017eadov\u00e1na v pokoji smluvn\u00edho partnera nebo v neobvyklou<br\/>denn\u00ed dobu (po 20:00 hodin\u011b a p\u0159ed 6:00 hodinou), je ubytovatel<br\/>opr\u00e1vn\u011bn za to po\u017eadovat zvl\u00e1\u0161tn\u00ed odm\u011bnu. Tato zvl\u00e1\u0161tn\u00ed odm\u011bna mus\u00ed b\u00fdt v\u0161ak<br\/>vyzna\u010dena na cen\u00edku pokoj\u016f. Ubytovatel m\u016f\u017ee tyto slu\u017eby z provozn\u00edch d\u016fvod\u016f tak\u00e9 odm\u00edtnout.<br\/>9.3 Ubytovatel m\u00e1 pr\u00e1vo na kdykoli prov\u00e9st vy\u00fa\u010dtov\u00e1n\u00ed, resp. mezit\u00edmn\u00ed vy\u00fa\u010dtov\u00e1n\u00ed sv\u00e9 slu\u017eby.  <\/p>\n\n<p><strong>Strana 7<\/strong><br\/>\u00a7 10 Povinnosti ubytovatele<br\/>10.1 Ubytovatel je povinen poskytovat sjednan\u00e9 slu\u017eby v rozsahu odpov\u00eddaj\u00edc\u00edm jeho standardu.<br\/>10.2 Zvl\u00e1\u0161tn\u00ed slu\u017eby ubytovatele, kter\u00e9 podl\u00e9haj\u00ed povinnosti ozna\u010den\u00ed a kter\u00e9 nejsou zahrnuty v odm\u011bn\u011b za ubytov\u00e1n\u00ed, jsou nap\u0159\u00edklad:<br\/>a) Zvl\u00e1\u0161tn\u00ed slu\u017eby ubytov\u00e1n\u00ed, kter\u00e9 mohou b\u00fdt \u00fa\u010dtov\u00e1ny zvl\u00e1\u0161\u0165,<br\/>jako je poskytnut\u00ed salonk\u016f, sauny, kryt\u00e9ho baz\u00e9nu,<br\/>baz\u00e9nu, sol\u00e1ria, gar\u00e1\u017ee atd.;<br\/>b) za poskytnut\u00ed p\u0159ist\u00fdlek, resp. d\u011btsk\u00fdch post\u00fdlek bude \u00fa\u010dtov\u00e1na sn\u00ed\u017een\u00e1<br\/>cena.<br\/>\u00a7 11 Odpov\u011bdnost ubytovatele za \u0161kody na vnesen\u00fdch v\u011bcech<br\/>11.1 Ubytovatel odpov\u00edd\u00e1 podle \u00a7\u00a7 970 a n\u00e1sl. ABGB za v\u011bci vnesen\u00e9 smluvn\u00edm partnerem. Odpov\u011bdnost ubytovatele je d\u00e1na pouze tehdy, pokud<br\/>byly v\u011bci p\u0159ed\u00e1ny ubytovateli nebo osob\u00e1m k tomu ubytovatelem pov\u011b\u0159en\u00fdm nebo p\u0159ineseny na m\u00edsto jimi ur\u010den\u00e9 nebo k tomu ur\u010den\u00e9. Pokud se ubytovateli nepoda\u0159\u00ed prok\u00e1zat opak, odpov\u00edd\u00e1 ubytovatel za sv\u00e9 vlastn\u00ed zavin\u011bn\u00ed nebo za zavin\u011bn\u00ed sv\u00fdch lid\u00ed a tak\u00e9 osob, kter\u00e9 vstupuj\u00ed a vystupuj\u00ed. Ubytovatel odpov\u00edd\u00e1 podle \u00a7 970 odst. 1 ABGB maxim\u00e1ln\u011b do v\u00fd\u0161e \u010d\u00e1stky stanoven\u00e9 ve spolkov\u00e9m z\u00e1kon\u011b ze dne 16. listopadu 1921 o odpov\u011bdnosti hostinsk\u00fdch a jin\u00fdch podnikatel\u016f v aktu\u00e1ln\u00edm zn\u011bn\u00ed. Pokud smluvn\u00ed partner nebo host neuposlechne v\u00fdzvy ubytovatele, aby sv\u00e9 v\u011bci ulo\u017eil na zvl\u00e1\u0161tn\u00edm m\u00edst\u011b k ulo\u017een\u00ed, je ubytovatel zpro\u0161t\u011bn ve\u0161ker\u00e9 odpov\u011bdnosti. V\u00fd\u0161e p\u0159\u00edpadn\u00e9 odpov\u011bdnosti ubytovatele je maxim\u00e1ln\u011b omezena v\u00fd\u0161\u00ed pojistn\u00e9 \u010d\u00e1stky odpov\u011bdnosti p\u0159\u00edslu\u0161n\u00e9ho ubytovatele. Zavin\u011bn\u00ed smluvn\u00edho partnera nebo hosta je t\u0159eba zohlednit.<br\/>11.2 Odpov\u011bdnost ubytovatele je vylou\u010dena pro lehkou nedbalost. Pokud je<br\/>smluvn\u00ed partner podnikatelem, je odpov\u011bdnost vylou\u010dena i pro hrubou nedbalost. V tomto p\u0159\u00edpad\u011b nese smluvn\u00ed partner d\u016fkazn\u00ed b\u0159emeno<br\/>pro existenci zavin\u011bn\u00ed. N\u00e1sledn\u00e9 \u0161kody nebo nep\u0159\u00edm\u00e9 \u0161kody a tak\u00e9<br\/>u\u0161l\u00fd zisk nebudou v \u017e\u00e1dn\u00e9m p\u0159\u00edpad\u011b nahrazeny.<br\/>11.3 Za cennosti, pen\u00edze a cenn\u00e9 pap\u00edry odpov\u00edd\u00e1 ubytovatel pouze do v\u00fd\u0161e \u010d\u00e1stky v sou\u010dasn\u00e9 dob\u011b 550,\u2013 EUR. Ubytovatel odpov\u00edd\u00e1 za \u0161kodu p\u0159esahuj\u00edc\u00ed tuto \u010d\u00e1stku pouze v p\u0159\u00edpad\u011b, \u017ee tyto v\u011bci p\u0159evzal do \u00faschovy s v\u011bdom\u00edm jejich povahy nebo v p\u0159\u00edpad\u011b, \u017ee \u0161koda byla zavin\u011bna j\u00edm samotn\u00fdm nebo n\u011bkter\u00fdm z jeho lid\u00ed. Omezen\u00ed odpov\u011bdnosti<br\/>podle 12.1 a 12.2 plat\u00ed obdobn\u011b.           <\/p>\n\n<p><strong>Strana 8<\/strong><br\/>11.4 Ubytovatel m\u016f\u017ee odm\u00edtnout \u00faschovu cennost\u00ed, pen\u011bz a cenn\u00fdch pap\u00edr\u016f, pokud se jedn\u00e1 o podstatn\u011b cenn\u011bj\u0161\u00ed p\u0159edm\u011bty, ne\u017e<br\/>host\u00e9 p\u0159\u00edslu\u0161n\u00e9ho ubytovac\u00edho za\u0159\u00edzen\u00ed obvykle d\u00e1vaj\u00ed do \u00faschovy.<br\/>11.5 V ka\u017ed\u00e9m p\u0159\u00edpad\u011b p\u0159evzat\u00e9 \u00faschovy je odpov\u011bdnost vylou\u010dena,<br\/>pokud smluvn\u00ed partner a\/nebo host vzniklou \u0161kodu neozn\u00e1m\u00ed neprodlen\u011b ubytovateli po zji\u0161t\u011bn\u00ed. Krom\u011b toho mus\u00ed b\u00fdt tyto n\u00e1roky uplatn\u011bny soudn\u011b do t\u0159\u00ed let od zji\u0161t\u011bn\u00ed nebo mo\u017en\u00e9 znalosti smluvn\u00edm partnerem, resp. hostem; jinak pr\u00e1vo zanik\u00e1.<br\/>\u00a7 12 Omezen\u00ed odpov\u011bdnosti<br\/>12.1 Pokud je smluvn\u00ed partner spot\u0159ebitelem, je odpov\u011bdnost ubytovatele za<br\/>lehkou nedbalost, s v\u00fdjimkou \u0161kod na zdrav\u00ed, vylou\u010dena.<br\/>12.2 Pokud je smluvn\u00ed partner podnikatelem, je odpov\u011bdnost ubytovatele za<br\/>lehkou a hrubou nedbalost vylou\u010dena. V tomto p\u0159\u00edpad\u011b nese smluvn\u00ed partner d\u016fkazn\u00ed b\u0159emeno pro existenci zavin\u011bn\u00ed. N\u00e1sledn\u00e9 \u0161kody,<br\/>nemajetkov\u00e9 \u0161kody nebo nep\u0159\u00edm\u00e9 \u0161kody a tak\u00e9 u\u0161l\u00fd zisk nebudou<br\/>nahrazeny. Hrazen\u00e1 \u0161koda v ka\u017ed\u00e9m p\u0159\u00edpad\u011b nach\u00e1z\u00ed svou hranici ve<br\/>v\u00fd\u0161i z\u00e1jmu na d\u016fv\u011b\u0159e.<br\/>\u00a7 13 Chov zv\u00ed\u0159at<br\/>13.1 Zv\u00ed\u0159ata sm\u00ed b\u00fdt do ubytovac\u00edho za\u0159\u00edzen\u00ed p\u0159ivedena pouze s p\u0159edchoz\u00edm souhlasem ubytovatele a p\u0159\u00edpadn\u011b<br\/>za zvl\u00e1\u0161tn\u00ed odm\u011bnu.<br\/>13.2 Smluvn\u00ed partner, kter\u00fd si s sebou bere zv\u00ed\u0159e, je povinen toto zv\u00ed\u0159e b\u011bhem<br\/>sv\u00e9ho pobytu \u0159\u00e1dn\u011b opatrovat, resp. dohl\u00ed\u017eet na n\u011bj, nebo<br\/>nechat toto na sv\u00e9 n\u00e1klady opatrovat, resp. dohl\u00ed\u017eet na n\u011bj vhodn\u00fdmi t\u0159et\u00edmi osobami.<br\/>13.3 Smluvn\u00ed partner, resp. host, kter\u00fd si s sebou bere zv\u00ed\u0159e, mus\u00ed m\u00edt odpov\u00eddaj\u00edc\u00ed poji\u0161t\u011bn\u00ed odpov\u011bdnosti za zv\u00ed\u0159e, resp. soukrom\u00e9 poji\u0161t\u011bn\u00ed odpov\u011bdnosti, kter\u00e9<br\/>pokr\u00fdv\u00e1 i mo\u017en\u00e9 \u0161kody zp\u016fsoben\u00e9 zv\u00ed\u0159aty. Doklad o odpov\u00eddaj\u00edc\u00edm poji\u0161t\u011bn\u00ed je t\u0159eba p\u0159edlo\u017eit na vy\u017e\u00e1d\u00e1n\u00ed ubytovatele.     <\/p>\n\n<p><strong>Strana 9<\/strong><br\/>13.4 Smluvn\u00ed partner, resp. jeho pojistitel ru\u010d\u00ed ubytovateli jako nerozd\u00edln\u00ed spoludlu\u017en\u00edci za \u0161kodu, kterou p\u0159iveden\u00e1 zv\u00ed\u0159ata zp\u016fsob\u00ed. \u0160koda zahrnuje zejm\u00e9na i ty n\u00e1hrady, kter\u00e9 mus\u00ed ubytovatel poskytnout t\u0159et\u00edm osob\u00e1m.<br\/>13.5 V salonech, spole\u010densk\u00fdch, restaura\u010dn\u00edch prostor\u00e1ch a wellness z\u00f3n\u00e1ch se zv\u00ed\u0159ata nesm\u00ed zdr\u017eovat.<br\/>\u00a7 14 Prodlou\u017een\u00ed ubytov\u00e1n\u00ed<br\/>14.1 Smluvn\u00ed partner nem\u00e1 n\u00e1rok na to, aby byl jeho pobyt prodlou\u017een. Pokud smluvn\u00ed partner v\u010das ozn\u00e1m\u00ed sv\u00e9 p\u0159\u00e1n\u00ed na prodlou\u017een\u00ed pobytu, m\u016f\u017ee ubytovatel s prodlou\u017een\u00edm smlouvy o ubytov\u00e1n\u00ed souhlasit. Ubytovatel k tomu nem\u00e1 \u017e\u00e1dnou povinnost.<br\/>14.2 Pokud smluvn\u00ed partner nem\u016f\u017ee v den odjezdu opustit ubytovac\u00ed za\u0159\u00edzen\u00ed, proto\u017ee v d\u016fsledku nep\u0159edv\u00eddateln\u00fdch mimo\u0159\u00e1dn\u00fdch okolnost\u00ed (nap\u0159. extr\u00e9mn\u00ed sn\u011b\u017een\u00ed, povode\u0148 atd.) jsou ve\u0161ker\u00e9 mo\u017enosti odjezdu uzav\u0159eny nebo nepou\u017eiteln\u00e9, prodlu\u017euje se smlouva o ubytov\u00e1n\u00ed automaticky po dobu nemo\u017enosti odjezdu. Sn\u00ed\u017een\u00ed odm\u011bny za tuto dobu je p\u0159\u00edpadn\u011b mo\u017en\u00e9 pouze tehdy, pokud smluvn\u00ed partner nem\u016f\u017ee v d\u016fsledku mimo\u0159\u00e1dn\u00fdch pov\u011btrnostn\u00edch podm\u00ednek pln\u011b vyu\u017e\u00edvat nab\u00edzen\u00e9 slu\u017eby ubytovac\u00edho za\u0159\u00edzen\u00ed. Ubytovatel je opr\u00e1vn\u011bn po\u017eadovat minim\u00e1ln\u011b tu odm\u011bnu, kter\u00e1 odpov\u00edd\u00e1 obvykle \u00fa\u010dtovan\u00e9 cen\u011b v mimosez\u00f3n\u011b.<br\/>\u00a7 15 Ukon\u010den\u00ed smlouvy o ubytov\u00e1n\u00ed \u2013 P\u0159ed\u010dasn\u00e9 ukon\u010den\u00ed<br\/>15.1 Pokud byla smlouva o ubytov\u00e1n\u00ed uzav\u0159ena na ur\u010ditou dobu, kon\u010d\u00ed uplynut\u00edm doby.<br\/>15.2 Pokud smluvn\u00ed partner odjede p\u0159ed\u010dasn\u011b, je ubytovatel opr\u00e1vn\u011bn po\u017eadovat plnou sjednanou odm\u011bnu. Ubytovatel ode\u010dte to, co si v d\u016fsledku nevyu\u017eit\u00ed jeho nab\u00eddky slu\u017eeb u\u0161et\u0159\u00ed nebo co obdr\u017eel pron\u00e1jmem objednan\u00fdch prostor jin\u00fdm osob\u00e1m. \u00daspora nastane pouze tehdy, pokud je ubytovac\u00ed za\u0159\u00edzen\u00ed v okam\u017eiku nevyu\u017eit\u00ed prostor objednan\u00fdch hostem pln\u011b vyt\u00ed\u017eeno a prostory mohou b\u00fdt na z\u00e1klad\u011b stornov\u00e1n\u00ed smluvn\u00edho partnera pronajaty dal\u0161\u00edm host\u016fm. D\u016fkazn\u00ed b\u0159emeno \u00faspory nese smluvn\u00ed partner.<br\/>15.3 \u00damrt\u00edm hosta kon\u010d\u00ed smlouva s ubytovatelem.        <\/p>\n\n<p><strong>Strana 10<\/strong><br\/>15.4 Pokud byla smlouva o ubytov\u00e1n\u00ed uzav\u0159ena na neur\u010ditou dobu, mohou smluvn\u00ed strany smlouvu zru\u0161it do 10:00 hodin t\u0159et\u00edho dne p\u0159ed zam\u00fd\u0161len\u00fdm koncem smlouvy.<br\/>15.5 Ubytovatel je opr\u00e1vn\u011bn smlouvu o ubytov\u00e1n\u00ed s okam\u017eitou platnost\u00ed<br\/>zru\u0161it z d\u016fle\u017eit\u00e9ho d\u016fvodu, zejm\u00e9na pokud smluvn\u00ed partner, resp.<br\/>host<br\/>a) u\u017e\u00edv\u00e1 prostory zp\u016fsobem, kter\u00fd je zna\u010dn\u011b nev\u00fdhodn\u00fd, nebo<br\/>sv\u00fdm bezohledn\u00fdm, ur\u00e1\u017eliv\u00fdm nebo jinak hrub\u011b nevhodn\u00fdm chov\u00e1n\u00edm znep\u0159\u00edjem\u0148uje sou\u017eit\u00ed ostatn\u00edm host\u016fm, majiteli, jeho zam\u011bstnanc\u016fm nebo t\u0159et\u00edm osob\u00e1m bydl\u00edc\u00edm v ubytovac\u00edm za\u0159\u00edzen\u00ed, nebo se v\u016f\u010di t\u011bmto osob\u00e1m dopou\u0161t\u00ed jedn\u00e1n\u00ed, kter\u00e9 je trestn\u00e9 proti majetku, mravnosti nebo t\u011blesn\u00e9 bezpe\u010dnosti;<br\/>b) je posti\u017een naka\u017elivou nemoc\u00ed nebo nemoc\u00ed, kter\u00e1 p\u0159esahuje dobu ubytov\u00e1n\u00ed, nebo se jinak stane osobou vy\u017eaduj\u00edc\u00ed p\u00e9\u010di;<br\/>c) nezaplat\u00ed p\u0159edlo\u017een\u00e9 faktury po splatnosti ve lh\u016ft\u011b (3 dny).<br\/>15.6 Pokud se pln\u011bn\u00ed smlouvy stane nemo\u017en\u00fdm v d\u016fsledku ud\u00e1losti, kterou lze pova\u017eovat za vy\u0161\u0161\u00ed moc<br\/>(nap\u0159. p\u0159\u00edrodn\u00ed \u017eivly, st\u00e1vka, v\u00fdluka, \u00fa\u0159edn\u00ed na\u0159\u00edzen\u00ed atd.),<br\/>m\u016f\u017ee ubytovatel ubytovac\u00ed smlouvu kdykoli zru\u0161it bez<br\/>dodr\u017een\u00ed v\u00fdpov\u011bdn\u00ed lh\u016fty, pokud smlouva ji\u017e nen\u00ed podle<br\/>z\u00e1kona pova\u017eov\u00e1na za zru\u0161enou nebo je ubytovatel zpro\u0161t\u011bn sv\u00e9 povinnosti ubytov\u00e1n\u00ed. P\u0159\u00edpadn\u00e9 n\u00e1roky smluvn\u00edho partnera na n\u00e1hradu \u0161kody atd.<br\/>jsou vylou\u010deny.<br\/>\u00a7 16 Onemocn\u011bn\u00ed nebo \u00famrt\u00ed hosta<br\/>16.1 Pokud host b\u011bhem sv\u00e9ho pobytu v ubytovac\u00edm za\u0159\u00edzen\u00ed onemocn\u00ed, ubytovatel na<br\/>p\u0159\u00e1n\u00ed hosta zajist\u00ed l\u00e9ka\u0159skou p\u00e9\u010di. V p\u0159\u00edpad\u011b nebezpe\u010d\u00ed z prodlen\u00ed ubytovatel zajist\u00ed l\u00e9ka\u0159skou p\u00e9\u010di i bez zvl\u00e1\u0161tn\u00edho p\u0159\u00e1n\u00ed hosta, a to zejm\u00e9na tehdy, pokud je to nutn\u00e9 a host s\u00e1m toho nen\u00ed schopen.<br\/>16.2 Dokud host nen\u00ed schopen rozhodovat nebo nelze kontaktovat p\u0159\u00edbuzn\u00e9 hosta, ubytovatel na<br\/>n\u00e1klady hosta zajist\u00ed l\u00e9ka\u0159sk\u00e9 o\u0161et\u0159en\u00ed. Rozsah t\u011bchto opat\u0159en\u00ed p\u00e9\u010de v\u0161ak kon\u010d\u00ed v okam\u017eiku, kdy host m\u016f\u017ee rozhodovat<br\/>nebo byli p\u0159\u00edbuzn\u00ed o onemocn\u011bn\u00ed informov\u00e1ni.   <\/p>\n\n<p><strong>Strana 11<\/strong><br\/>16.3 Ubytovatel m\u00e1 v\u016f\u010di smluvn\u00edmu partnerovi a hostu nebo v p\u0159\u00edpad\u011b \u00famrt\u00ed v\u016f\u010di jejich pr\u00e1vn\u00edm n\u00e1stupc\u016fm n\u00e1rok na n\u00e1hradu zejm\u00e9na za n\u00e1sleduj\u00edc\u00ed n\u00e1klady:<br\/>a) nezaplacen\u00e9 n\u00e1klady na l\u00e9ka\u0159e, n\u00e1klady na sanitn\u00ed dopravu, l\u00e9ky a zdravotnick\u00e9 pom\u016fcky<br\/>b) nezbytn\u00e1 dezinfekce m\u00edstnosti,<br\/>c) znehodnocen\u00e9 pr\u00e1dlo, lo\u017en\u00ed pr\u00e1dlo a vybaven\u00ed l\u016f\u017eka, jinak za dezinfekci nebo d\u016fkladn\u00e9 vy\u010di\u0161t\u011bn\u00ed v\u0161ech t\u011bchto p\u0159edm\u011bt\u016f,<br\/>d) obnova st\u011bn, vybaven\u00ed, koberc\u016f atd.,<br\/>pokud byly v souvislosti s onemocn\u011bn\u00edm nebo \u00famrt\u00edm zne\u010di\u0161t\u011bny nebo po\u0161kozeny,<br\/>e) n\u00e1jemn\u00e9 za pokoj, pokud byl prostor hostem vyu\u017e\u00edv\u00e1n,<br\/>plus p\u0159\u00edpadn\u00e9 dny nepou\u017eitelnosti prostor z d\u016fvodu<br\/>dezinfekce, vyklizen\u00ed apod.,<br\/>f) p\u0159\u00edpadn\u00e9 dal\u0161\u00ed \u0161kody, kter\u00e9 ubytovateli vzniknou.<br\/>\u00a7 17 M\u00edsto pln\u011bn\u00ed, soudn\u00ed p\u0159\u00edslu\u0161nost a volba pr\u00e1va<br\/>17.1 M\u00edstem pln\u011bn\u00ed je m\u00edsto, kde se nach\u00e1z\u00ed ubytovac\u00ed za\u0159\u00edzen\u00ed.<br\/>17.2 Tato smlouva se \u0159\u00edd\u00ed rakousk\u00fdm form\u00e1ln\u00edm a hmotn\u00fdm pr\u00e1vem s<br\/>vylou\u010den\u00edm pravidel mezin\u00e1rodn\u00edho pr\u00e1va soukrom\u00e9ho (zejm\u00e9na IPRG a EV\u00dc)<br\/>a tak\u00e9 \u00damluvy OSN o smlouv\u00e1ch o mezin\u00e1rodn\u00ed koupi zbo\u017e\u00ed.<br\/>17.3 V\u00fdhradn\u00ed soudn\u00ed p\u0159\u00edslu\u0161nost je v oboustrann\u00e9m podnikatelsk\u00e9m vztahu s\u00eddlo<br\/>ubytovatele, p\u0159i\u010dem\u017e ubytovatel je nav\u00edc opr\u00e1vn\u011bn uplatnit sv\u00e1 pr\u00e1va<br\/>i u jak\u00e9hokoli jin\u00e9ho m\u00edstn\u011b a v\u011bcn\u011b p\u0159\u00edslu\u0161n\u00e9ho soudu.<br\/>17.4 Pokud byla ubytovac\u00ed smlouva uzav\u0159ena se smluvn\u00edm partnerem, kter\u00fd je spot\u0159ebitelem<br\/>a m\u00e1 bydli\u0161t\u011b, resp. obvykl\u00e9 m\u00edsto pobytu v Rakousku, mohou b\u00fdt \u017ealoby proti spot\u0159ebiteli pod\u00e1ny v\u00fdhradn\u011b v m\u00edst\u011b bydli\u0161t\u011b, obvykl\u00e9ho pobytu nebo v m\u00edst\u011b zam\u011bstn\u00e1n\u00ed spot\u0159ebitele.<br\/>17.5 Pokud byla ubytovac\u00ed smlouva uzav\u0159ena se smluvn\u00edm partnerem, kter\u00fd je spot\u0159ebitelem<br\/>a m\u00e1 bydli\u0161t\u011b v \u010dlensk\u00e9m st\u00e1t\u011b Evropsk\u00e9 unie (s v\u00fdjimkou Rakouska), Islandu, Norsku nebo \u0160v\u00fdcarsku, je pro<br\/>\u017ealoby proti spot\u0159ebiteli m\u00edstn\u011b a v\u011bcn\u011b p\u0159\u00edslu\u0161n\u00fd soud v\u00fdhradn\u011b p\u0159\u00edslu\u0161n\u00fd soud v m\u00edst\u011b bydli\u0161t\u011b spot\u0159ebitele.<\/p>\n\n<p><strong>Strana 12<\/strong><br\/>\u00a7 18 Ostatn\u00ed<br\/>18.1 Pokud v\u00fd\u0161e uveden\u00e1 ustanoven\u00ed nestanov\u00ed jinak, po\u010d\u00edn\u00e1 b\u011bh<br\/>lh\u016fty doru\u010den\u00edm p\u00edsemnosti, kter\u00e1 lh\u016ftu stanov\u00ed, smluvn\u00edm partner\u016fm, kte\u0159\u00ed mus\u00ed lh\u016ftu dodr\u017eet. P\u0159i v\u00fdpo\u010dtu lh\u016fty, kter\u00e1<br\/>je stanovena podle dn\u016f, se nezapo\u010d\u00edt\u00e1v\u00e1 den, do kter\u00e9ho spad\u00e1 okam\u017eik nebo ud\u00e1lost, podle kter\u00e9 se m\u00e1 \u0159\u00eddit po\u010d\u00e1tek lh\u016fty.<br\/>Lh\u016fty stanoven\u00e9 podle t\u00fddn\u016f nebo m\u011bs\u00edc\u016f se vztahuj\u00ed k tomu dni t\u00fddne nebo m\u011bs\u00edce, kter\u00fd sv\u00fdm ozna\u010den\u00edm nebo \u010d\u00edslem odpov\u00edd\u00e1<br\/>dni, od kter\u00e9ho se m\u00e1 lh\u016fta po\u010d\u00edtat. Pokud tento den v dan\u00e9m<br\/>m\u011bs\u00edci chyb\u00ed, je rozhoduj\u00edc\u00ed posledn\u00ed den v tomto m\u011bs\u00edci.<br\/>18.2 Prohl\u00e1\u0161en\u00ed mus\u00ed b\u00fdt druh\u00e9mu smluvn\u00edmu partnerovi doru\u010dena nejpozd\u011bji posledn\u00ed den<br\/>lh\u016fty (24:00).<br\/>18.3 Ubytovatel je opr\u00e1vn\u011bn zapo\u010d\u00edst proti pohled\u00e1vce smluvn\u00edho partnera vlastn\u00ed pohled\u00e1vky.
